We at CompanyCam, Inc. (“we,”​“us,” or​“CompanyCam”) respect your privacy. This Privacy Policy (“Policy”) applies when you visit our website, com​pa​ny​cam​.com (“Website”), when you use our web and mobile applications (“Apps,” and together with the Website, Services”), when you interact with us over the phone, email or other communication, when you apply for a position with us, visit us at a trade show or other event, or use another online website or platform that links to this privacy policy. In this Policy, we explain the types of Personal Information we collect and how we use, share, and protect that Personal Information.

Personal Information does not include publicly available information or aggregated information that does not include personal identifiers.

      • Examples of the Identifiers We Collect: Name, alias, postal address, phone number, unique personal identifier, online identifier, internet protocol address, email address, customer account name, Social Media handle, or other similar identifiers.
      • How Long We Retain Identifiers: We retain this information for so long as you maintain an account with us, while we keep a business relationship with you, and for so long as required for any other business or legal purpose.

      Customer Records

      • Examples of Customer Records We Collect: When you sign up for a free trial or a subscription to the Services, we do not directly collect credit or debit card information. All credit and debit card data is provided directly to our PCI-compliant, third-party payment processor, Stripe. To confirm your payment, Stripe will send us the last 4 digits of your payment card number.
      • How Long We Retain Customer Records: We retain this information for so long as you maintain an account with us, while we keep a business relationship with you, and for so long as required for our business and legal purposes.

      Protected Classification Information

      • Examples of Protected Classification Information We Collect: For job applicants and employees, you may provide us with information about your gender, ethnic origin, or eligibility to work in the U.S.
      • How Long We Retain Protected Classification Information: We retain this information for as long as we are required to by law.

      Commercial Information

      • Examples of Commercial Information We Collect: Records of your subscriptions, content of texts, emails, or survey answers you send to us, in-service messages between customers, purchases you made in the Services.
      • How Long We Retain Commercial Information: We retain this information for so long as you maintain an account with us, while we keep a business relationship with you, and for so long as required for any other business or legal purpose.

      Internet Activity

      • Examples of Internet Activity We Collect: Internet or other electronic network activity information, including your IP address, browsing history, and information regarding your interaction with our Services, keyboard and mouse movements, online identifiers like cookie ID, browser type, your internet service provider, operating system, and date and time you used the Services.
      • How Long We Retain Internet Activity: We retain this information for so long as you maintain an account with us, while we keep a business relationship with you, and for so long as required for any other business or legal purpose.

      Geolocation Data

      • Examples of Geolocation Data We Collect: Imprecise location information, such as the city, state, or zip code associated with your IP address when you visit the Services. 
      • How Long We Retain Geolocation Data: We retain this information for so long as you maintain an account with us, while we keep a business relationship with you, and for so long as required for any other business or legal purpose.

      Audio and Visual Information

      • Examples of Audio and Visual Recordings We Collect: When you use the App, you can capture pictures and video of the work site, including the metadata associated with the video or photo, for your records.

        When you communicate with our sales and customer service teams over the phone, we record the call.

        Sometimes, we ask certain industry professionals to speak to us about their work. If you agree to speak with us over Zoom, with your prior consent, we will save a recording of the interview for our internal business purposes.

      • How Long We Retain Audio and Visual Recordings: We retain sales calls for at least 3 years or for so long as you maintain an account with us, while we keep a business relationship with you, and for so long as required for any other business or legal purpose.

        If you consent to a Zoom recording, we will save the recording for so long as needed for our business purposes.

        We retain your photos and your account information until you request us to delete your account.

      Professional and Employment Information 

      • Examples of the Types of Employment Information We Collect: When you use the Service, this information may include your company name, your title, and other company details including address and phone number. When you apply for an open position with us, this information may include your employment history and work experience, or when you are hired for a position with us such as your Social Security number and other governmental identification numbers, financial account information, racial or ethnic identity, and health information. 
      • How Long We Retain Professional or Employment Information: We delete your employment information in your account if you request to delete your account. If you provided this information to us when you applied for a position or onboarded as a new employee, we retain this information for as long as we are required to by law.

      Education Information

      • Examples of Education Information We Collect: Your education history and related information you provide when you apply for a position with us.
      • How Long We Retain Education Information: We retain this information for as long as we are required to by law.

      Sensitive Information: Precise Geolocation Data

      • The Sensitive Personal Information We Collect: We will collect your precise geolocation when you take a photo using the App to connect your location to the photos taken. 
      • How Long We Retain Geolocation Data: We retain the precise geolocation information associated with the pictures you take in the App for as long as you have an account with us.

      3. What are the Sources of the Personal Information We Collect?

      Information You Provide to Us

      Explanation: We will collect Personal Information you provide to us when you subscribe to the Services, when you create an account, when you sign up for a free trial of our Services, when you provide us with feedback, when you communicate with us, when you communicate with other users of the Service, when you take photos or videos using the Services, when you participate in one our promotions, or when you submit an application for an open position with us.

      Information We Collect Through Other Customers’ Use of the Services

      • Explanation: Other customers may provide us with your Personal Information to the Services to create your account or invite you to the Services. 
      • Customers may upload photos and videos of work sites for their records that may include images and audio of you at the work site. We do not actively monitor uploaded photos or videos for personal information. Customers may input contact information about their clients (the person whose property they are working on, their Clients”). We do not use this information for any purpose except to store it and process it on behalf of our customers. Our customers are responsible for obtaining your permission to collect your Personal Information.

      Information Collected Automatically Using Technology

      We use technology to automatically collect certain Personal Information relating to your use of the Services. To learn more about how we use technology to collect Personal Information and your options to limit the data collected while using the Services, see Section 7 below.

      Account Activity and Usage Data
      • Explanation: If you use the Services while signed into your customer account, we will collect information about how you use the Services, such as diagnostic and usage data that may be linked to your account.
      • Categories Collected: Identifiers, Internet Activity, and Geolocation Data.
      Cookies & Other Tracking Technologies
      • Explanation: We use cookies, web beacons, pixel tags and other tracking technologies (collectively Cookies”) when you use our Services. Through our use of Cookies in the Services, we may collect information such as the websites you visit before or after you visit the Services, how you navigate the Website, keyboard activity, mouse clicks and movements, your IP address, location information, search requests, browser type, operating system, cookie IDs, date and time you visit use the Services, or the amount of time spent on the Services. 
      • Categories Collected: Identifiers, Internet Activity, and Geolocation Data.

      Third-Party Sources

      We obtain data from our business partners that is necessary to conduct our business and provide the Services. We also obtain data from our marketing and advertising partners to improve our marketing and advertising.

      Payment Processor
      • Purpose of Collection and Use: Facilitating Purchases.
      • Explanation: When you make a purchase, we use a PCI-compliant payment processor, Stripe (“Payment Processor”) to help us facilitate payment. We have contracted with the Payment Processor to ensure they protect and limit the use of your Personal Information. We do not receive your credit card, debit card or other financial information when you make a purchase online — that information is provided directly to our Payment Processor. However, we do receive the last four numbers of your payment card used to make the purchase. We will keep a record of your purchases.

      Service Providers
      • Purpose of Collection and Use: Marketing, Business Purposes.
      • Explanation: We use service providers to request feedback from you in the form of surveys and questionnaires, to provide customer service, and to host the Services. We use third parties or service providers to enhance our marketing capabilities.

      Analytics Providers
      • Purpose of Collection and Use: Business Purposes.
      • Explanation: We may use third parties or service providers to help us understand and improve the functionality of the Services.

      • Explanation: To respond to your customer service requests or any other inquiry or correspondence from you, including responding to you through our live chat feature on the Website, to provide you with educational and informational content about the Services, notifying you of changes to our Terms of Use and this Policy, responding to your request to exercise your California Privacy Rights, or as you request or consent.

      To Create and Maintain Your Subscription

      • Explanation: To complete your request for a subscription to the Services and to fulfill and manage your subscription and maintain your payment information. To reduce risk of fraud and process your refund requests and subscription cancellations.

      • Explanation: To create and manage your customer account, account information, and account settings, to maintain your password, and to maintain your subscription.

      To Provide, Manage, and Improve Our Services

      • Explanation: To help us understand which features in our Services to improve or develop, to troubleshoot issues, to improve the content functionality of our Services, to customize your experience, and to analyze our communications with you, Website traffic, use of the Services, and your feedback. We may also use Personal Information with our machine learning and artificial intelligence models, including but not limited to, training such models.

      To Market and Advertise to You

      • Explanation: To serve targeted advertising to you about products and services we believe may be of interest to you, to enhance our marketing capabilities, to notify you of new products, services, and promotions, to customize content and to improve our ability to contact you, and to inform marketing and communication plans and strategies. We may obtain your Social Media handle if you interact with us on Social Media.

      For Promotional Purposes

      • Explanation: You may participate in our referral program by sharing a unique promo code provided by us with individuals in your network. If anyone signs up for our Services using your promo code, we may send you CompanyCam-branded items or enter you to win a prize as part of the terms of the applicable promotion.

      Business Purposes

      • Explanation: To inform our business strategies, to understand Services demographics and user preferences, to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as part of bankruptcy, liquidation, or similar proceeding.
      • Categories Collected: Identifiers, Customer Records, Commercial Information, Internet Activity, Protected Classification Information, Audio and Visual Recordings, Professional and Employment Information, Geolocation, and Sensitive Personal Information.

      To Process Job Applications 

      • Explanation: To enable you to fill out our job application and submit application materials, to allow you to send email communications about your job applications or inquiries about our open positions, and to process and track job applications.

      For Employment Purposes

      • Explanation: We may collect Personal Information for background checks, drug screenings and other such information in connection with the hiring process or as relevant to an individual’s employment.

      To Protect Our Rights

      • Explanation: To bring a legal action against you or anyone who may be causing harm to our Services, our customers, or to other users of the Services. To seek business, financial, or legal advice; To respond to subpoenas, court order and other legal processes.
      • Categories Collected: Identifiers, Customer Records, Commercial Information, Internet Activity, Protected Classifications, Audio and Visual Recordings, Professional and Employment Information, Geolocation, and Sensitive Personal Information.

      5. How Do We Use Deidentified or Aggregated Information?

      We may create, use, disclose, share, license, or transfer aggregate data to create de-identified, aggregated data on users of the Services. This data describes users as a group but cannot be used to identify you as an individual. We may use aggregated data to understand users’ needs, to determine user demographics and usage patterns, to determine what kinds of products and services we can provide, and to improve and enrich our products and services and the Website. We will not re-identify that Personal Information and other information once aggregated.

      6. When Do We Disclose or Share Personal Information?

      Below, we list the types of entities with whom we have Disclosed or Shared Personal Information in the last 12 months for business purposes or to serve targeted advertising or direct marketing, or related purposes.

      We Disclose or Share your Personal Information with the following types of third parties:

      Website and App Hosting Service Providers, Email Service Provider, Job Application Processing Service Provider, and other Data Processing Service Providers

      • Purpose: We may Disclose Personal Information with service providers that host and manage our Services, maintain our customer service platform, provide email services to us, process job applications and onboard new employees, store and process data on our behalf and pursuant to our instructions, and support or provide for the security of our Services.

      Website Analytics Partners

      • Purpose: We may use your Personal Information to develop and improve the functionality of the Services, evaluate customer needs, customize Website content and your browsing experience. We may use it to operate and troubleshoot problems with the Services or conduct statistical and other analysis of the Services.

      Social Media, Marketing and Advertising Partners

      • Purpose: We may use Personal Information to serve targeted advertising to you, develop marketing materials, communicate with you about our Services, notify you of new products and programs to enhance our marketing capabilities, and inform our marketing and communication plans and strategies.

      Government Officials/​Law Enforcement

      • Purpose: We will cooperate with law enforcement and other governmental agencies, and may disclose Personal Information: (i) if we believe in good faith we are legally required to disclose that Personal Information, (ii) if we are contractually required to do so to fulfill audit requirements for government agency clients; (iii) if we are advised to disclose Personal Information by our legal counsel, or (iv) when necessary to identify, contact or bring a legal action against someone who may cause or be causing harm to, or interfering with the legal rights of CompanyCam or any other party.

      • Categories: Identifiers, Customer Records, Commercial Information, Internet Activity, Geolocation Data, Protected Classification Information, Audio and Visual Recordings, Employment Information, Education Information, and Sensitive Personal Information.

      Change in Ownership

      • Purpose: In the event that CompanyCam is the subject of a due diligence process concerning the sale of the company in whole or in part, through sale, merger or acquisition or in the event of a bankruptcy, receivership or a similar transaction, we may provide Personal Information to the prospective or subsequent owner(s). In these circumstances, Personal Information may be shared with actual or prospective purchasers or successors and may be transferred in the case that the transaction is completed.

      When Explicitly Requested or Consented to by You

      7. How Do We Use Technology in the Services?

      We use analytics services and targeted advertising cookies in addition to location features in connection with your use of the Services. We use cookies, web beacons, pixel tags, and other technologies (collectively Cookies”) on our Services to automatically collect information used to improve the Services and to advertise to you. A cookie is a small text file that our Services saves onto your computer or device when you use the Website. 

      A Cookie can either be a session” Cookie or a persistent” Cookie. Session Cookies exist only for so long as you are visiting the Website and are typically deleted when you exit your web browser. Each time you visit a website that has implemented a persistent Cookie, the persistent Cookie is renewed, and that Cookie will remain active until its predetermined expiration date. 

      Analytics Tools

      We use third-party software tools on our Website to learn more about how visitors navigate the Website and view content. These third-party analytics providers provide use with analytical information collected through their Cookies that we use to improve the Website, to make sure it is easy to use, and to develop content that is both interesting and customized.

      • Google Analytics and Its Advertising Features: We have enabled and implemented Google Analytics with signals, Google Tag, Google Dynamic Remarketing, and DoubleClick, a Google Analytics Advertising Feature. To prevent Google from using data collected by Google Analytics, follow the instructions to download and install the Google Analytics Opt-out Browser Add-on for each web browser you use. Using the Google Analytics opt-out browser add-on will not prevent us from using other analytics tools and will not prevent data from being sent to the Website itself or to Google. Opting out will not affect your use of the Website.       • Session Replay: Microsoft Clarity: We have implemented and may use session replay software offered by Microsoft Clarity. The session replay software allows us to collect information about how you navigate and use our Website in real-time. Microsoft Clarity collects information including date and time you visited the Site, mouse clicks, mouse movements, keystrokes, and text input (sensitive personal information is masked), scrolling, webpage or content loading times and site errors. Other Personal Information Microsoft Clarity collects includes IP addresses, browser information, device IDs, and operating system. Additionally, Microsoft collects or receives Personal Information from the Website to provide Microsoft Advertising services.       • HubSpot Analytics: We use HubSpot Analytics, a web analytics tool, to assist us in understanding how our Website is used. HubSpot Analytics utilizes various tracking technologies to generate information we select about your use of our Services, which may include information about websites or online services visited before a device accesses our Services, metrics about the performance of our Services, and information about how devices access our Services.       Targeted Advertising

      We use service providers and other third parties to serve you customized email, SMS, and internet-based advertisements. Those ad networks use Cookies and other tracking technologies to serve ads based upon your prior visits to our Website and other websites. These ad networks may place and store cookies on the devices you use to access our Services and collect information including your browsing behavior, referring sites, and your response to advertisements.

      You may see advertising for CompanyCam’s products in your email or on other websites based on your browser behavior across websites. You may also see our ads on Social Media networks because Social Media networks use interest preferences that you have chosen on those websites, as well as registration and other information about you, to choose which ads to display to you.

      • Meta Pixel: We use the remarketing services of Meta, Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA (“Meta”) on our website. We use Meta Custom Audiences to deliver targeted advertisements to website visitors across those Meta-owned Social Media platforms based on email addresses that we have collected.       • TikTok Pixel: We use TikTok’s analytics services. TikTok collects customer data and browser behavior from our Services to optimize our ad targeting experience. TikTok services help track our ads’ impact on our Website, and allows us to receive insights from our visitors and their site behavior. To learn more, please visit TikTok’s Privacy Policy.
      • X Advertising and Conversion Tracking: We use the analytics and advertising services of X to provide you with personalized advertising and measure the success of our advertising campaigns.       • LinkedIn Ads: We may use LinkedIn Ads to display search advertisements and to track when you have visited or used our Services. If you click on a LinkedIn Ads advertisement, LinkedIn Ads stores a cookie on your device that is used to track the number of individuals who click on a LinkedIn Ads advertisement and are forwarded to the applicable website.       How We Secure Your Personal Information

      We take precautions to protect the Personal Information we collect. We have implemented commercially reasonable physical, technological, and administrative procedures to protect the Personal Information we maintain from loss, misuse, and alteration appropriate to the type of Personal Information processed.

      Access From Outside the United States 

      If you access the Services from outside the United States, please be aware that Personal Information may be transferred to, stored in, and processed in the United States. Certain governmental authorities may not consider the level of protection of Personal Information in the United States to be equivalent to that required by other jurisdictions. If you share your Personal Information when visiting the Services, you consent to the processing of that Personal Information in the United States.

      Access by Children

      The Services are not directed at children 16 years of age and under. We do not knowingly collect, use, or share Personal Information from children 16 or under. If a parent or legal guardian learns that their child provided us with Personal Information without his or her consent, please contact us and we will make commercially reasonable attempts to delete such Personal Information.

      Third-Party Websites

      The Services may link to websites that we do not maintain or control. CompanyCam is not responsible for the privacy or security policies or practices of any third parties or any third-party websites. If you choose to access third-party websites, you do so at your own risk, and you should read the terms and conditions and privacy policies for each website that you visit.

      Social Media Websites

      CompanyCam participates in Social Media platforms such as Facebook, X, LinkedIn, Instagram TikTok, YouTube, and Reddit (“Social Media”) that enable online sharing and collaboration among customers. The Website may allow you to connect to and share information with these various Social Media platforms. These features may require us to implement Cookies, plug-ins, and application protocol interfaces (APIs) provided by those Social Media platforms to facilitate those communications and features.

      By choosing to use any third-party Social Media platform or choosing to share content or communications with any Social Media platform, you allow us to share information with the designated Social Media platform. We cannot control any policies or terms of any Social Media third-party platforms. Your use of Social Media is governed by the privacy policies and terms of the third parties that own and operate those websites and not by this Notice. We encourage you to review those policies and terms. As a result, we cannot be responsible for any use of your information or content by a third-party platform, which you use at your own risk.

      YouTube. We use the YouTube application programming interface (API) services to allow you to access YouTube content from our Services. Your use of YouTube is governed by YouTube’s Terms of Service and Privacy Policy.       Services You Link to Your Account 

      We receive information about you when you or your account administrator enables third-party apps, or integrates or links a third-party service with our Services. For example, you may authorize our Services to access and display files from a third-party document-sharing service within the services interface. The information we receive when you link or integrate our Services with a third-party service depends on the settings, permissions and privacy policy controlled by that third-party service. You should always check the privacy settings and notices in these third-party services to understand what data may be disclosed to us or shared with our services.

      10. Your Privacy Choices

      We offer several ways for you to control how your Personal Information is collected, used, or shared:

      Update Your Personal Information.

      You can update your Personal Information by accessing your account or contacting us using the information in Section 11 below.

      Delete Your Account.

      If you no longer wish to use the Services or access your account or account information, you may request us to delete your account by contacting us using the information in Section 11 below. This will result in full, permanent deletion of your account and associated information such as the photos stored in your account. We will not be able to recover your account after it has been deleted.

      Update Your Browser Settings.

      If you are a California, Texas, or Nebraska resident, applicable state law provides you with certain rights regarding your Personal Information or Personal Data. These rights are subject to limitations such as (a) exceptions permitted by applicable law and (b) verification of your identity. This section provides a summary of your privacy rights and explains how to request to exercise those rights with us. 

      In the event of a conflict between this Section and the remainder of this Policy, this Section shall govern for residents of California, Texas, and Nebraska.       Right to Opt Out

We will comply with such requests and direct our service providers to do the same, subject to certain exceptions permitted by applicable law.

      California, Texas, and Nebraska residents have the right to request that we correct their inaccurate Personal Information or Personal Data. If we receive such a request, we will use commercially reasonable efforts to comply. If necessary, we may ask for documentation showing that the Personal Information or Personal Data we maintain is inaccurate.

      Right to Data Portability

      California, Texas, and Nebraska residents have the right to request a copy of the Personal Information or Personal Data that we collected from them in a portable and, to the extent technically feasible, readily usable format.

      How to Exercise Your Rights to Access, Delete, Correct, and Data Portability

      To exercise the access, data portability, correct, and deletion rights described above, please submit a verifiable consumer request to us by either:

      Except when we receive a request to opt out, we cannot respond to your request without sufficient information to allow us to reasonably verify your identity and confirm that the Personal Information or Personal Data is related to you.

      When we receive your request to exercise your rights: (a) We will acknowledge receipt of your request; (b) We will try to match the information you provide in making the request with information we already maintain; © If required to verify your identity, we may ask you to provide additional information, including Personal Information or Personal Data; (d) We will consider various factors when determining how to verify your identity, such as the sensitivity and value of the data, the risk of harm, and the likelihood of fraud.

      We will only use Personal Information or Personal Data provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request. If you maintain an account with us, we may use that account to respond to your request and/​or verify your identity. If we are unable to verify your identity as required by applicable laws and regulations, we will decline to comply with your request, and let you know why.

      Who Can Exercise Your Rights?

      Only you, or a person that you authorize to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of your minor child.

      Texas and Nebraska residents have a right to submit a request to opt out through an authorized agent. California residents have a right to submit requests to exercise any rights under the CCPA through an authorized agent. You may designate an authorized agent to make a request on your behalf to exercise your rights by doing the following: (1) Provide the authorized agent written permission to do so; (2) Verify your identity. We may deny a request from an authorized agent if we do not have proof that they are authorized by you to act on your behalf. We will not require authorized agents to verify your identity to effectuate an opt-out request. We may deny a request from an authorized agent if we do not have proof that they are authorized by you to act on your behalf.

      When We Will Respond

      We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time, we will inform you of the reason and extension period.

      If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

      Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. We may charge a fee to process or respond to your request unless it is excessive, repetitive, or manifestly unfounded. 

      Right to Non-Discrimination

      California, Texas, and Nebraska residents have the right to not receive discriminatory treatment for exercising any of their rights under the CCPA, TDPSA, or NDPA. We do not discriminate against you if you exercise any of your privacy rights described in this Policy.
